Amendments to the Town’s Commercial Right-of-Way Use Code advanced at the Nov. 11 meeting when Town Attorney Linehan recommended removing an exception that previously only required franchise utilities to obtain permits where their franchise agreement mandated it. The proposed change would require permits for any use or disturbance of Town right-of-way under BAVMC 12.20.
Councilmember Brad Wheeler moved to pass Ordinance No. 484 to implement the change, with Councilmember James McCarthy seconding. The motion passed 5–0. The revision standardizes permit requirements across users of the Town right-of-way according to the language the Town Attorney recommended.
