Beaux Arts Village adopts amended Critical Areas rules ahead of Dec. 31 deadline

Beaux Arts Village's Town Council voted unanimously on Dec. 9 to adopt Ordinance No. 487, which amends the town's Critical Areas regulations. Town Engineer Stacia Schroeder reviewed changes made since prior meetings and led council discussion on whether to require permanent fencing and to record CARA (Critical Aquifer Recharge Area) notices on property titles. The council removed both the permanent-fencing and title-noting requirements and kept a prohibition on subdivisions in critical areas while allowing exceptions for properties affected only by the CARA.
Clerk/Treasurer Sue Ann Spens relayed legal counsel's advice that recording property-title notes would add administrative burden without providing additional protection; after discussion the Council reached consensus to remove that requirement. Councilmember Stacy Saal moved to pass Ordinance No. 487 so the town could meet the 12/31/2025 adoption deadline; the motion was seconded and approved 5-0.
The ordinance updates local land-use protections for groundwater and environmentally sensitive areas; the Town Engineer indicated the changes incorporated comments from the prior meeting and follow-up emails.
