Marco Island magistrate dismisses citation for electric scooter in park

The City moved to dismiss a citation alleging operation of an electric scooter in a park at Rockport Court after the issuing officer could not attend the hearing. Magistrate Robert Print confirmed the relevant code section (ordinance 34-3 q3b related to operation of bicycles and electric bicycles in certain public spaces) but, with no officer testimony available, the City informed the court it would dismiss the case and the magistrate did so.
Magistrate Print addressed the respondent directly: "Sir, this is your lucky day. They're dismissing the case at this time." The dismissal means no fines were imposed and the matter is closed for the present record unless revisited by new evidence or a new citation.
