Butler County approved Resolution No. 26-12 on March 24 to establish a temporary common consumption area at Applejack Pumpkin Patch (Hwy 400 & SW Indianola Rd.) for wine festival events on April 18 and April 25, 2026. County Administrator Will Johnson said the resolution was modeled on a prior ABC‑approved template the County has used and that the authorization is limited to the two April dates; additional events would require separate resolutions and ABC review.
The statute cited by staff, K.S.A. 41-2659, allows cities and counties to create common consumption areas and authorize possession and on‑site consumption of alcoholic liquor within a defined boundary for specific events. The Board approved the resolution 5-0.
