After questions and discussion, Mr. Chavez moved to deny the request "due to the Cool Jet Pen not being in the NRS chapter 643 scope of practice," a motion seconded by Mr. Foley and approved unanimously. The Board did not adopt an alternate path for limited pilot use during this meeting and did not direct staff to seek a formal advisory opinion.
The decision rests on the Board's interpretation of its scope under NRS chapter 643; no amendment to rules or guidance was made at the meeting. Board members did not record specific safety findings allowing the device, and Clearman was not granted authorization to use the device in barber facilities.
