The applicant asked the commission to rezone 61.31 acres of tract 1490 (Area 2) to an APD zoning district to align the site with the city’s future land use plan and allow residential development at a proposed Area 2 density of 2.68 units per acre. Ron Ramirez, who identified himself as president of Evolving Texas, said the request would apply only to the 61.31-acre Area 2 and that the adjacent Area 1 would remain zoned CPD.
"Tonight we're asking for approval of zoning of the 61 acres... We're asking for APD in a manner consistent with the future land use map and a Benbrook comprehensive plan," Ramirez said, describing proposed minimum buffers of 50 feet on the north and 40 feet on the west. Applicant representatives said those buffers would increase in places based on final grading and floodplain work.
Applicant representatives also described a $500,000 "neighbor resilience" commitment tied to the APD approval. A presenter said that $500,000 could be used to leverage FEMA or other matching programs and "help unlock up to $2,000,000 of improvement dollars for existing residents affected by Mary's Creek." The applicant's attorney, Tommy Mann, described the rezoning as a land‑use request and emphasized that regulatory floodplain approvals would occur through separate FEMA and city review processes.
