Yachats planning commission preliminarily reviews invasive-plant code, schedules public hearing

The Yachats Planning Commission on Nov. 18 discussed a draft code amendment that would define and regulate noxious and invasive vegetation and move detailed species lists out of the municipal code into an externally maintained list. Chair Mark Sakamoto opened the work session by noting the item was prepared by staff and that “the first item on the agenda for the work session is the noxious and invasive vegetation section that Lauren has been working on,” signaling the commission’s role in initial review and later public hearings.

City Planner Catherine Gunther told commissioners the item was placed before the commission because the Planning Commission handles required public hearings for code amendments and said the goal was to avoid embedding long, highly specific plant lists directly into code. “So this isn’t really a planning commission project, but it landed here because you guys are best suited to all the required public hearings for code amendment,” Gunther said, adding that linking to a maintainable list (e.g., guidance from the county Soil and Water Conservation District) would allow updates without another code amendment. Commissioners pressed staff on enforcement and liability — whether the city would be expected to enforce removals on private property and whether the draft language could expose owners to civil claims for allergic reactions — and asked that counsel and the drafter Lauren address those points before the public hearing.
