The Planning and Zoning Commission recommended that City Council consider rezoning 21 parcels totaling about 4.335 acres from Commercial District C3 to Residential District RD-5 in the Mitchell/Lawrence/Cabot area.
Benjamin Johnson, city project planner, said the request is part of the commission's plan of work to align zoning with existing land uses and future land-use recommendations. Johnson told the commission that staff mailed 67 public notifications, received a packet with nine property-owner signatures opposing the change and one additional emailed comment; he also noted one property owner who owns four properties voiced support.
Commissioners asked staff about practical effects such as the application of the no-development buffer where commercial and residential abut, whether a parking-lot owner would be affected and how nonconforming uses would be treated after a fire or demolition. Johnson explained nonconforming structures may be repaired under the nonconforming-use section up to 60 percent of appraised value but would require conditional-use review if rebuilt beyond that threshold.
After discussion — including options to exclude a single parcel from the city-initiated rezoning if needed — the commission voted to recommend approval to City Council. The commission noted the council will have discretion and that rezoning is intended to allow by-right residential redevelopment where appropriate.
