Owner and staff back rezoning of 400 Oak St. to allow assisted-living use

The Bryan Planning and Zoning Commission unanimously recommended that the City Council approve a rezoning of 1.321 acres at 400 Oak Street from MU2 (mixed-use) to Retail District C2 to permit an assisted-living facility as a by-right use in the C2 district.
Benjamin Johnson, the city project planner, said the site sits near the Texas Avenue corridor and staff determined the rezoning would permit the applicant to use the existing structure as an assisted-living facility after an owner/tenant change-of-use application and the certificate-of-occupancy process. "Approving this request will allow the applicant to use the existing structure as an assisted living facility," Johnson said.
Elena Schlachta, who identified herself as the property owner, told commissioners she and the ownership group bought and restored the property and "are anxious to use it as commercial." She provided the property's address for the record as 400 Oak Street. Following a short public hearing with no opposition, a commissioner moved to recommend approval; the commission voted to recommend approval unanimously.
