Neighbors’ Water and Drainage Concerns Lead Planning Commission to Table 80‑Acre Rezoning

The Planning Commission voted 5-0 to table RZ 26-07, a request from BJ Ventures LLC to rezone about 80+/- acres from AG‑40 to Residential Estates (RE) to allow a nine‑lot preliminary plat. Multiple area residents spoke at the public hearing, pressing commissioners on rural character, water availability and drainage: Larry Schurr said wells could go dry and urged the commission to wait, and several neighbors described concerns about pond and creek drainage and the potential impacts of increased density.
Director Toby Stewart told the commission the property is inside the Urban Growth Area and that rural water would need to be extended from SW 40th Street; he said staff would research what actions are available and consult the County Counselor. Commissioner Marsha Francis moved to approve the rezoning but lacked a second; Commissioner Talon Griggs moved to table the request 60 days to allow staff time to investigate water‑supply and potential regulatory options, and that motion carried 5-0.
