Justice of the Peace seeks refunds after AG opinion finds automated-ticketing method unlawful; court approves reimbursements

Judge Julie Patterson of Precinct 3 told Commissioners Court she stopped processing automated citations after the District Attorney's office sought an Attorney General opinion on the legality of a vendor-supplied automated enforcement method; Patterson said the subsequent opinion determined the tickets issued in this manner were not lawful. She reported approximately 516 tickets were issued during the relevant period and that 57 payments had been made. The court approved a request to use general-fund monies to reimburse $11,004.80 to affected individuals and ordered staff to work with DPS and the DA's office to reverse convictions and expunge records where appropriate.

Patterson described the steps taken to dismiss the tickets in her court and to identify paid cases for refund. ‘‘There were approximately 516 tickets that were issued on this...There were 57 tickets that people paid money...so the money we are requesting today...is for those 57 tickets where people paid money to refund that money to those folks,’’ she said. Commissioners emphasized the seriousness of the administrative and personal impact on residents (time off work, travel, fines) and commended Patterson's office for taking prompt corrective action; the court approved the motion by voice vote and directed staff to update the court on conviction reversals and expungements.
