ADEM gives public-comment instructions, posts exhibits and sets written-comment deadline

Designated hearing officer Tom Burks detailed how members of the public could participate and how the hearing record will be assembled. Burks said copies of the proposed rules were filed as "unit T-1" and that a summary of reasons supporting adoption was entered as "exhibit P-2." He said copies of the notices of publication have been submitted as exhibits C-1 through C-4 and a listing of notified individuals appears as Exhibit C-5.
Burks stated that copies of the proposed rules have been available for inspection at ADEM field offices in Birmingham, Mobile, Decatur and Montgomery and on the agency’s website. "All testimony and written statements should be as factual as possible and should address the subject of this hearing," Burks said. He set the deadline for written comments at 05:00 PM on Tuesday, Oct. 7, 2025, at ADEM offices in Montgomery and said the department will provide a written response to each relevant comment and to those requesting notice of the decision.
Burks also said that lengthy technical statements should be submitted in writing and that summaries of such statements may be presented orally. The department noted that it will include the transcript, written submissions and exhibits in the final hearing record and that those materials will be available at ADEM offices in Montgomery once the record is complete.
