Commissioner Alexander (speaker 12) and others raised concerns about outputs and enforcement: numeric standards for noise, opacity and emissions were requested. Greg Dale (consultant) and staff explained the approach in the draft relies on a clear intent statement, definitions and performance standards that allow staff to require applicants to demonstrate compliance; appeals would remain available to applicants dissatisfied with staff determinations.
Greg said quantifying every potential pollutant or byproduct in a zoning code is challenging and that the staff approach provides flexibility to review unfamiliar uses and require specialized expertise where necessary. "The way it's set up right now is the staff has the ability to say to an applicant, demonstrate that you're minimizing adverse environmental impacts," Greg said. Commissioners asked staff to sharpen language about inputs and outputs, and to return with suggested measurable standards where feasible.
