At the meeting, Miss Bester told council there is one pending rezoning application — an almost 5-acre parcel currently zoned SF1 for which the applicant seeks SF3. The Planning & Zoning Commission has recommended approval and staff noted alignment with the future land use map is a key factor in how council will consider the case.
Council members asked whether the city could be liable if it denied a PD or rezoning; staff and the city attorney said denial is within council and P&Z discretion when an application fails PD criteria and that any legal exposure is fact-specific. Bester said staff will prepare a parcel list and the recommended changes so council can evaluate pending and previously approved PDs together before making policy changes.
