Board schedules follow-up on multiple complaints and permits; Koenig lawsuit no update
Summary
The board forwarded a water-related complaint report to attorneys and invited parties to the Jan. 20 meeting, said it will monitor Surface Drain Permit No. 6710 (Neil Breidenbach) and Dacotah Bank’s complaint, and recorded there was no update on the Koenig lawsuit stemming from 2017–2018 obstruction proceedings.
Moore has forwarded the Complaint for Water-Related Issues Investigation Report to the McLaughlins' attorney and requested that the McLaughlins attend the Board’s Jan. 20 meeting; the Board will also invite the complaining parties. The board recorded that it will keep the matter on future agendas and invite affected parties to discuss the report.
The board also will keep Surface Drain Permit No. 6710 (permit holder: Neil Breidenbach) and Dacotah Bank’s related complaint on meeting agendas and will maintain contact with the parties to monitor whether conditions of the permit are satisfied. Chairman Jason Siegert said he will contact Mr. Breidenbach for a status update. The board noted there was no update on the lawsuit filed by La Verne Koenig related to obstruction complaint proceedings in 2017–2018.
