Henry County accepts 1.305-acre parcel from Henry County Medical Center for future Health Department/EMS site

Commissioners accepted a donated 1.305± acre parcel (Lot 9, Van Dyck Subdivision) from Henry County Medical Center to be used for a county Health Department or EMS facility; the deed restricts use to county health/EMS through Oct. 1, 2049, and requires construction and certificate of occupancy by Oct. 1, 2029 or reconveyance to the hospital.
Henry County approved Resolution 9-9-24 on Sept. 16 to accept conveyance of Lot No. 9 in Van Dyck Subdivision (Tax Map 106, Parcel 028.00), a 1.305± acre parcel conveyed by Henry County Medical Center (HCMC) to the Government of Henry County at no monetary consideration. Commissioner Monte Starks moved the resolution and Commissioner David Webb seconded; the motion passed unanimously.
The recorded warranty deed and interlocal attach restrictive covenants: the parcel shall be used exclusively by Henry County to construct and operate a County Health Department or an EMS operation, and that restriction expires Oct. 1, 2049. The interlocal allows for a reconveyance to HCMC if the county does not complete construction and obtain a Certificate of Occupancy by Oct. 1, 2029 (with an option for a mutually agreed one-year extension). The legal description and survey (on file) list the parcel boundaries, a +/- 1.305-acre area, and show existing easements and setback lines. The deed and interlocal were recorded in the Register's Office (recording noted Sept. 30, 2024). County officials said the parcel will be the planned Health Department site; the deed also includes a narrow covenant barring use for ophthalmic/optometric services directly by the parcel.
