Homeowner Ted Ugeta and architect Gregory Lewis told the board the gravel driveway preexisted purchase (about 19 years) and that the applicant has agreed not to pave it and to remove an asphalt pad on Forest Avenue as part of closing permits. Lewis said the gravel has not historically bled onto neighbors' yards.
Charlotte Abadir moved to approve the area variance to legalize the driveway as historically sited, adding a condition that a mechanism (metal edging or similar) be installed if gravel migration becomes a problem. Board and applicant agreed the condition was reasonable; the motion passed on roll call. The applicant and the board noted that if maintenance fails the neighbor can complain and enforcement measures could be applied.
