Chaffee County commissioners on June 16 continued consideration of an intergovernmental agreement (IGA) with Pueblo Water related to the Clear Creek Dam safety and downstream filter‑berm project. County staff said the work is underway under state dam‑safety direction and that Pueblo Water has provided text edits to the draft IGA that correct ownership and citation language.
Miles, the county presenter, told the board that the substantive mitigation provisions remain the same and that Pueblo Water agreed to escrow $17,000 with the county "to cover" reapplication of magnesium‑chloride dust mitigation on County Road 390 if the project's truck traffic damages the road. "Pueblo has agreed through the assigned GA to escrow 17,000 with the county," Miles said, describing the escrow as a good‑faith measure to protect the county's dust‑mitigation investment.
Commissioners expressed a desire to see a clean, updated version of the packet that incorporates Pueblo Water’s edits before taking final action. One commissioner called the packet process "sloppy" given late edits; Miles explained the county published the version available at the packet deadline and received edits from Pueblo Water the day before the meeting. The board voted to continue the item to the July 7 meeting to permit staff to circulate the revised documents and for commissioners to review the final language.
The continuation does not stop construction on the ground; staff said Pueblo Water had already begun some of the work because of dam‑safety priorities, and the IGA language reflects that construction may proceed while finalizing document edits. A follow‑up packet is expected before the July 7 meeting.
