Land Office approves $55,000 settlement in time-sensitive case; vote 3-1

The Commissioners of the Land Office voted 3-1 on Feb. 19 to approve a $55,000 payment to resolve claims in a pending lawsuit, the board said at an emergency meeting in Oklahoma City.
General Counsel Perry Tirrell told the Commission he "recommended for the Commission to vote to accept the plaintiff's demand of a $55,000 payment to resolve the claims in this case," and asked that the Secretary be authorized to execute a settlement agreement and file the necessary pleadings to dismiss the case. Commissioner Blayne Arthur moved to accept the recommendation; Commissioner Lindel Fields seconded.
The roll call recorded Commissioners Fields, Arthur and Lt. Gov. Matt Pinnell voting "Aye" and Commissioner Cindy Byrd voting "Nay," producing a carried motion to approve the settlement. The board took the action after an executive session to discuss the legal matter and returned to open session before voting.
The payment and authorization to execute the agreement conclude the board action recorded at the emergency meeting; the record shows staff and counsel were directed to complete the documentation needed to resolve and dismiss the case.
