Teller County updates on-site wastewater rules; transfer-of-title program reinstated

The Teller County Board of County Commissioners, sitting as the Board of Health on June 9, approved a comprehensive update to the county's on-site wastewater treatment system (OWTS) regulations to align with state Regulation 43. County staff said the package is about 210 pages and includes several substantial changes to bring county rules up to date with modern septic technologies.
Austin, the presenting staff member, told commissioners one of the largest changes is reinstating a transfer-of-title program the county had rescinded about 11 years ago; the new rules also allow certain size reductions for higher-level treatment systems when an operation-and-maintenance contract is in place. Austin said the regulation will become effective 45 days after adoption, placing the effective date at 07/24/2026 if adopted at the June 9 meeting.
Commissioners discussed outreach to realtors and municipalities and emphasized the public-health rationale for clearer inspections and fee schedules. Commissioner Williams praised the public-health protections, saying the changes are necessary "particularly when we have septic systems within a few 100 feet of what we drink our water." The measure passed by roll call.
