Chaffee County commissioners voted July 7 to approve an intergovernmental agreement with Pueblo Water that lets the utility proceed with the Clear Creek Dam safety project while avoiding a full 1041 permit process. Miles (county staff) told the board Pueblo Water would implement a weed-management and revegetation plan and deposit $17,000 in escrow to cover any road maintenance related to the work.
"Pueblo Water has agreed to make sure that they follow a weed management and reseeding plan," Miles said, and the escrow will be used by road and bridge “to reapply any mag chloride or rework that road” if needed, with unused funds to be refunded at project conclusion. The board heard no public opposition and approved the agreement by voice vote.
Commissioners said the agreement balances the county’s interest in limiting impacts to roads and public lands while allowing the dam-safety work to proceed. The item was described as an intergovernmental alternative to a 1041 permit; officials noted Pueblo Water had already cleared its water board and legal reviews. The county record will reflect the escrow arrangement and the mitigation commitments as part of the agreement’s conditions.
