Board approves outside-counsel contract with Trucker Haas, adds termination clause

The Fire & Police Disability & Retirement Board voted to adopt Resolution 566 to authorize a contract with Trucker Haas to provide outside general-counsel services previously supplied under an Ogletree Deacons agreement. Staff told trustees the proposed term is May 18, 2026, through Jan. 21, 2030, with a not-to-exceed amount of $150,000.
An agency official said the city attorney’s office is negotiating the contract and that staff will include a termination clause so the board is not left without counsel if the named attorney moves firms. The board discussed whether earlier 2026 billings under the Ogletree contract should affect the new $150,000 cap; staff said work performed before May 18 remains under Ogletree and the new contract covers only work after that date. "Any bills he sent to us after May 18 or work done after May 18 will be covered under the Tucker Haas contract," the staff member said.
Trustee discussion focused on timing and the dollar cap; one trustee noted earlier billings appeared immaterial and accepted staff’s explanation that January–May amounts would remain under the prior contract. A motion to adopt the resolution as revised (to include the forthcoming termination clause) carried unanimously on roll call.
