Committee discusses liability and insurance for contract pregnancy checkers

After discussing certification requirements, the committee turned to insurance questions for people who might be paid to perform pregnancy determinations. Daniel York, an independent agricultural insurance agent with TechLearn Associates, told members that basic general liability policies have exclusions for professional liability or errors and omissions and that owners/operators usually ask contractors for proof of liability insurance via a certificate of insurance.
York said a contractor could purchase primary coverage but that many general liability policies exclude professional services unless additional coverage is purchased. "Basic general liability always has exclusions, and or limitations for any professional liability or errors and omissions," he said. Committee members debated whether the operator should be responsible for verifying coverage, whether 10‑99 contractors could realistically obtain the required coverage, and whether the state should mandate additional insurance; York and other witnesses urged that verification remain at the operator level rather than creating a new statutory insurance obligation.
