Committee weighs e-bike, e-scooter rules including school permits and helmet requirement

Niskayuna committee members spent the opening portion of the meeting sorting through a draft e-bike and e-scooter ordinance that would apply to riders 16 and older and include an education component tied to school parking permits.

"The thought is, would the high school be interested in doing that for e-bikes or e-scooters that you have to have a school parking permit?" the staff member said, proposing that the high school serve as a point of permit issuance and safety training. Committee members also discussed offering adult education at the public library or through town web resources.

Members raised enforcement and equipment-class issues, noting many devices in use are modified or unclassified. "Everyone's riding illegal e-bikes... they're riding uphill 30 miles an hour without pedaling," one committee member said, warning current categories may not cover new models that switch between pedal assist and full electric operation.

The group debated a helmet mandate as both a safety measure and an enforcement trigger. One member asked whether requiring helmets would give police probable cause to stop riders; others said a uniform rule for both bikes and e-bikes would simplify messaging even if enforcement proved selective.

Staff said she will consolidate two drafts, mark edits in color or strikethrough for committee review and bring a revised draft to the August meeting, with the aim of forwarding a recommendation to the town board in September.
