Developer representatives Dakota Hyde and Jeff Hyde told the council the system, as installed, crosses newly created property lines and therefore requires a 'body politic' sponsor under Weber‑Morgan Health Department guidance and Utah Administrative Rule R317. Dakota Hyde asked the town to “consider sponsorship as a body politic for the Compass Rose Lodge / North Arrow Lofts wastewater system,” language he used in a written request provided to the council. Town Attorney William Morris prepared the agreement and the developers accepted edits; Councilmember Artie Powell requested mostly grammatical and easement‑related clarifications to ensure the town would not assume financial responsibility for repairs or replacements.
The resolution incorporates a written Sewer Maintenance Agreement that records the developer’s ongoing obligation to operate, maintain and fund inspections for the system; the agreement grants the town an easement to inspect but specifies that actual maintenance and most costs are the developer’s responsibility. The council voted 5–0 to approve the resolution, with Mayor Richard L. Sorensen and four councilmembers in favor.
The project team had previously received a review from the Weber‑Morgan Health Department noting the system’s design accommodated the additional flow but that subdivision without prior health‑department oversight created a permitting issue; the department letter identified two remedies: combine the lots or secure a sponsoring body politic. The approved agreement says the town may be recorded as sponsor while reserving the town’s right to require reimbursement if it must act to enforce compliance.
The council’s action clears a permitting obstacle that developers said is the last approval needed to start construction on the North Arrow units. The resolution and the sewer‑sponsorship agreement will be executed by the mayor and recorded as needed.
