The Huntsville Town Council on Dec. 5 adopted Ordinance 2024-11-06, a comprehensive update to the town’s subdivision code and codification into Title 15. The Planning Commission and Hansen Planning Group had worked on the revisions for several months, and the ordinance was the product of multiple drafts and a public hearing earlier in November.
During the Council discussion, TCM Artie Powell raised concerns about Section 15.17.17.B.2 as it pertains to nonconforming lots and consolidations. Powell described a scenario where two legally buildable but nonconforming lots could remain nonconforming after consolidation, and asked for an exception to avoid perpetuating practical difficulties for property owners. Mayor Pro Tem Sandy Hunter agreed to draft specific exception language and return it to the Planning Commission for their review before final codification. Mayor Richard Sorensen then moved to approve the ordinance with the recommended changes; the motion passed on a roll call vote recorded in the minutes.
The adopted ordinance replaces the Town’s existing subdivision regulations with a reorganized Title 15 that clarifies application requirements, preliminary and final plat procedures, improvement guarantees, inspection standards, and exceptions for minor and agricultural subdivisions. The text establishes an improved review cycle and timelines for both applicants and the Town, lays out improvement bonding requirements and warranty terms, and formalizes standards for street, drainage and utility improvements.
