Planning Commission recommends approval of Penn Home & Farm lot addition with conditions

The Salem Township Planning Commission voted on Sept. 4, 2024 to recommend approval of Penn Home & Farm LLC’s request to add Lot 1 to the property of John and Patricia Kilpatrick, subject to a set of conditions the commission required be shown on the final plan.
The commission listed 13 conditions the applicant must satisfy, including showing a 30-foot front building setback from Mark Drive and 10-foot side and rear setbacks, labeling the Kilpatrick driveway, adding the Mark Drive right-of-way width and identification number, and identifying any sanitary sewer easements. The commission also required SEO, Township and DEP approvals and documentation from the Pennsylvania Department of State confirming Penn Home & Farm LLC’s registered address and members.
The commission required that the plan include the following note: "Penn Home and Farm owns 54 Mark Drive, Tax Map Parcel No. 57-12-00-0-032, access to Tax Map Parcel No. 57-12-00-0-021 from Mark Drive is available through that property." The commission made clear this note must be placed on the recorded plan.
Resident Ken Brozack questioned whether there was a recorded right-of-way to access the rear parcel. Solicitor Gary Falatovich replied that the original Garden Courts Plan of Lots referenced two proposed 50-foot streets in the 1960s but that those streets were not dedicated to the township or opened, and there was no recorded easement to reach the back parcels. The commission noted that Penn Home & Farm also owns parcel 57-12-00-0-032 and will access the rear parcel from that property.
A motion by Planning Commission member Paul Holleran, seconded by Chair Connie Mattei, recommended approval subject to the listed conditions; both voted in favor and the motion passed unanimously.
