The Elko County Commission voted to join a coordinated amicus brief with the Central Nevada Regional Water Authority, Humboldt River Basin Water Authority and other counties to defend vested water rights the board said are adjudicated by state courts.
Commissioners described the action as standing up for state jurisdiction over water rights after a federal assertion that would narrow the federal government’s waiver of sovereign immunity for pre‑1952 water claims. "By us supporting that litigation ... we're basically standing up for state rights on water rights," a commissioner summarized during discussion. The motion to join the amicus brief passed and staff were directed to notify the Central Nevada Regional Water Authority contact (Jeff Fontaine) of the county’s participation before the filing deadline.
The county estimated the total legal cost to be about $18,000 divided among participants, for a county share under $5,000. Commissioners said the action aligns with regional partners and NACO's participation and emphasized the significance of maintaining state courts’ primacy in water adjudications.
