"The legislative intent behind this proffer, meaning that what was actually set out to be done, ... was to keep our community safe," the petitioner said. He acknowledged the board’s legal constraints but urged supervisors to weigh intent and local impacts when deciding whether to overturn the zoning administrator’s determination. He also said the local code and legislative context have changed since 2000 and that data‑center uses were not contemplated at the time the proffer was written.
Staff and several supervisors pushed back in the hearing, saying the legal question before the board is whether the zoning administrator correctly applied the proffer’s text and the defined standard of general compliance. Board members asked the petitioner to tie his broader concerns back to the specific listed appeal points (notice, fire‑access commentary, and technical illustrations).
