The Zoning Board of Adjustment voted on Jan. 22, 2026 to approve variance 2025-0018, reducing the minimum rear-yard setback from 15 feet to 5 feet for single-family detached housing proposed on Lots 6 and 7 on the north side of East Main Street between North Lobeth and North Carol.
Staff member summarized the request and recommended approval, saying, "This request is to decrease the minimum rear yard setback from 15 feet to 5 feet for a single family detached unit within the mid density residential zoning district." Staff told the board the lots are legal nonconforming because each lacks the 6,000-square-foot lot area required today but were lawfully created previously. Staff also described three variance criteria—public interest, unique hardship specific to the property, and preservation of the ordinance spirit—and concluded the proposal met those tests and would allow reasonable single-family development compatible with the neighborhood.
Staff reported the city mailed 26 notices to nearby property owners within 300 feet and received a single written comment opposing the request; the comment expressed concern that a 5-foot rear setback could limit space for storage, animals, or drainage. The staff presentation clarified that the proposed setback would be measured from a dedicated 16-foot alley in the rear and that "it will not" interfere with the drainage ditch, according to staff remarks at the hearing. The property owner was not present at the meeting.
A board member moved to approve the variance; the motion was seconded and the board voted in favor by voice (three ayes), after which the Chair declared the motion carried. The board was advised of the appeals process and deadline following the decision.
The board adjourned at approximately 6:11–6:12 p.m.
