Geneva County adopts ACCA Debt Setoff resolution to cover all departments

The Geneva County Commission unanimously adopted an ACCA Debt Setoff Program resolution on May 27 extending participation to all county departments, including Solid Waste, Probate, Revenue and Road & Bridge, to pursue collection of delinquent fees by setoff of a debtor’s Alabama income tax refund.
Chairman Toby Seay introduced the resolution and said it would "include all departments of the county so it would not require amending in the future." Commissioner Bart Wilks moved to adopt the resolution and Commissioner Weston Spivey seconded; the motion passed 4-0. The resolution and the program mechanics were discussed in general terms at the meeting; the meeting packet includes the full resolution and the participation agreement language describing responsibilities and notice procedures.
The adopted resolution directs the county to execute a participation agreement with the Association of County Commissions of Alabama to administer setoff submissions to the Alabama Department of Revenue and to establish the review/hearing procedures required under Ala. Code § 40-18-103 and § 40-18-104. The Commission recorded its vote to adopt that resolution; County staff will follow the Association's procedures for submitting eligible debts and handling contests under state law.
