Planning commission backs code updates to temporary uses, gives farmers market longer season

The Sandy Planning Commission voted to recommend changes to chapter 17.74 of the municipal code to the city council, adding a carve-out that would allow the Mount Hood Farmers Market or a “substantially similar” event to operate up to 200 days a year instead of the current 90-day limit.

"We did add a carve out for the Mount Hood Farmers Market or any substantially similar event," the Director of Planning and Building said during the staff presentation, explaining the change was requested at a March work session and reviewed with the city attorney. The amendments also clarify when utility or engineer-signed plans are required for temporary structures and revise emergency-declaration language to list governmental agencies rather than specific officials.

Commissioners discussed how the code will affect longstanding festivals (Mountain Festival, Music Fair & Feast) and private events. Staff recommended retaining the existing council-exemption path for city-sponsored or co-sponsored events while using temporary-use permits for private events on private property. One commissioner urged caution about allowing combustible sheds for fireworks stands and suggested requiring fire-retardant tents certified by manufacturers and the fire marshal.

The commission approved a motion to forward the draft amendments to the city council with an amendment directing staff to work with council and the city attorney to create an exception process for city-sponsored events. The commission's recommendation will be incorporated into an ordinance (referred to at the meeting as ordinance 2026-10) for council consideration.
