Board initiates Sanitary Code rewrite to align county language with state rules

Cortland County staff proposed standardizing how the county's Sanitary Code references the New York State Sanitary Code, limiting county additions to stricter local standards and creating a process for regular updates.
Cortland County Health Department staff told the Board of Health on Jan. 20 that the county's Sanitary Code, last amended in 2019, will be rewritten for clarity and regular maintenance.
Don Ware, Director of Environmental Health, said some articles in the county code currently reproduce state text verbatim while others merely reference the New York State Sanitary Code; staff recommended a consistent approach that states the county follows state regulations and limits county "additions" to standards the board has thoughtfully considered. Ware cited Article XIII Public Water Systems as an example, noting the county does not allow a disinfection waiver tied to an earlier BOH policy from 2010.
The board directed staff to proceed with a detailed review and to present revisions that make the code more concise and easier to update on a regular basis.
