Alexandra Missan, the property manager for the Shops at Montero Association, told the magistrate she is new to the role and that maintenance of the right-of-way was added to the association’s contract after the violation was identified. She told the court: "I was new I'm the new property manager and I didn't realize that even though it's not on our property boundary that it was for us to maintain." (Alexandra Missan).
Magistrate Scott Kleinman said he would find a violation existed but acknowledged the association was now in compliance; he ordered a $150 administrative fee for today's proceeding payable within 30 days and explained the resulting order will be recorded in Broward County if unpaid. The association stated the check had been mailed, and staff confirmed prior payments on related cases.
