City counsel told the hearing the parties “were in extensive negotiations” and presented an agreed first amendment, which included terms that the city could enforce and that dismissal by the city and the district was part of the approval. Kleinman said he would vacate the prior order as recommended and formally dismissed the case. The action resolves the landscape installation and maintenance dispute for the property at 8451 Northwest 39th Street pending the county commission’s handling of related items.
