CEDA amends Oct. 5, 2023 minutes after Clark Shawnee court order

The Central CEDA Regional Planning Commission of Clark County voted Jan. 21, 2026, to amend its Oct. 5, 2023 regular meeting minutes to reflect a Dec. 23, 2025 Decision and Order in Clark Shawnee Local School District Board of Education v. CEDA, Case No. 23CV0744. The board adopted the resolution unanimously after a motion by Mr. Sunny Dhingra and a second by Mr. Greg Rogers.

The Decision and Order, cited in the resolution read into the record, found that CEDA violated R.C. 121.22(c) by failing to promptly prepare, file, and maintain meeting minutes from the Oct. 5, 2023 meeting. The court noted that the minutes were “not accurate and obviously misleading” in that the final result of the plat consideration was recorded as an approval when the vote was to disapprove. The Order issued an injunction under R.C. 121.22(I)(1) compelling CEDA to comply with the Open Meetings Act and imposed a $500 civil forfeiture plus reasonable attorney fees. The minutes text submitted at the emergency meeting also notes that CEDA has filed a Notice of Appeal in the case but that it intends to comply with the court’s Order.

The resolution directs that the Oct. 5, 2023 minutes be amended to include the court’s findings and that a copy of the December 23, 2025 Order be attached to the minutes. The adoption vote was recorded as: Yes — Mr. Sunny Dhingra, Mr. Greg Rogers, Ms. Theresa Hartley (chairperson), Mr. Bob Mako, Mrs. Katy Ryan Schilke, Mr. Tim Sheerin, and Mr. Lorin Wear; No — none.

The commission did not take additional public action on the underlying plat decision at this emergency meeting. The amended minutes and the attached court Order will become part of the public record for the Oct. 5, 2023 meeting as directed by the resolution.
