Commissioner Merl Page moved to recess to an executive session beginning at 9:38 a.m. for up to 30 minutes under K.S.A. 75-4319(b)(4) for Confidential Data (trade secrets) and private information. The motion was seconded by Commissioner Gary D Yenzer and carried 4-0.
Those recorded as attending the executive session were County Administrator Chad Kinsley, County Counselor Bernard Irvine, Zoning Administrator Gregg Webster, and representatives of Beltline Energy (Rich Eckart, Charles Kontz and Ryan Sanders). The board resumed the open meeting at 10:08 a.m., extended the executive session twice, and resumed finally at 10:45 a.m. The minutes state no action was taken as a result of the session.
The minutes identify the statutory authority cited for the closed session as K.S.A. 75-4319(b)(4) (trade secrets/confidential data). Because the discussion was held under the executive-session privilege, the minutes appropriately do not describe the substantive confidential information discussed.
