Commissioners spent substantial time on the proposed permit term. Staff said the draft supplied by the applicant requested a 99-year permit; several commissioners objected and signaled a preference for the commission's usual 50-year term. One commissioner said, "50 is plenty," while another noted that a 99-year term is "about as close as you can get to permanent." The commission also reviewed standard conditions including proof of liability insurance and a requirement that the project be in "substantial compliance" with the most recent concept plan; some members expressed concern that the applicant-proposed wording could limit the zoning administrator's discretion.
Riparian protections and stream-impairment status were central topics. Commissioners reviewed previous conditions requiring that trees along the Shenandoah River not be removed and asked staff to draft explicit language protecting the riparian buffer. Staff noted Department of Environmental Quality (DEQ) listings indicating the creek is "impaired" but also explained the impairment appears driven by natural channel changes rather than pollution, and that the legal limits on regulating riparian buffers will be checked.
The commission heard from an applicant representative on the phone who said a bridge shown on the plans will guide access and that most visitors would likely walk along the creek but not wade. After the discussion a commissioner moved to set the SUP for public hearing on "07/14/2026." The motion was seconded and, following roll call, the hearing date was approved.
Next steps: staff will draft clarified buffer and compliance language for the SUP conditions and the item will appear at the commission's July 14 public hearing.
