Commission approves home-occupation for Summerhays Digging Corp with storage limits

The Planning Commission approved a conditional-use permit allowing Neil and Laurie Summerhays Digging Corp to store a mini-excavator and a flatbed trailer in a detached garage at 12383 South 540 East (application 2024-0264-USC). Nick Whitaker told the commission the owner has held an office-only business license since 2014 and is now seeking formal conditional-use approval to add on-site equipment storage.
Applicant Neil Summerhays said he has operated the excavation business for eight years and sometimes stores equipment on-site; he told commissioners the excavator and trailer "can go in there for occasional time" and that most jobs keep equipment off-site for extended periods. Neighbors at the public hearing said they had not observed concerning activity and noted the property is well screened by a block wall. Commissioners moved to approve with conditions limiting equipment to one mini-excavator and one flatbed trailer stored inside the accessory structure and prohibiting storage on the street; the motion passed by voice vote.
Staff will include the storage limitations in permit conditions and monitor compliance during license renewals and inspections.
