Council declares 0.36-acre triangle surplus to resolve driveway encroachment (Resolution 24-41)

Draper staff asked the council to declare surplus a 0.36-acre triangular parcel near 1300 East so an adjacent property owner can purchase the portion necessary to correct an encroaching driveway.
Assistant City Manager Kelly Schalberg said the city completed a title search, determined the parcel’s origin and concluded selling a small portion would allow the neighbor to be in compliance. Staff will obtain an appraisal to set price and return with sale terms. Council adopted Resolution 24-41 unanimously to permit the appraisal and follow-up sale work.
The council directed staff to proceed with appraisal and report back on pricing and sale terms consistent with state law and city code.
