He also summarized a legal opinion he previously requested that found commissioners, as elected officials, have the right to use county property for activities they objectively believe benefit the county but that such use may carry liability. "These types of activities clearly do have potential liability and do increase the county's risk exposure," he said, adding that many officials weigh benefits against risks. The commissioner said the legal opinion guided his earlier decisions and will continue to inform board practice.
Commissioners discussed public questions about use of the county building by citizen groups and after-hours meetings; one commissioner said if the county lease allows renting space to entities such as the soil district, he would bring a memorandum and a board vote forward. Another commissioner noted there is not currently a written policy for preferred groups meeting in county facilities and suggested the board consider a formal policy or memorandum agreement in future sessions.
