Applicants Andrew and Margaret Horvath told the board that Better Living Sunrooms began work on their back porch in December and that contractors deconstructed and later rebuilt windows and walls to create a three-season sunroom. The Horvaths said the porch retained its original concrete floor and roof line and that the contractor handled permitting; they learned in May that zoning authorization for an enclosure was required after the building permit work had already occurred.
Lieutenant Powell, speaking for the municipality, explained that building and zoning departments operate separately: the building department had issued a permit for work they reviewed, but the zoning department later denied the enclosure because zoning authorization should precede building work. The contractor subsequently resubmitted permits for the steps and the building department later inspected the steps; the board heard that the sunroom structure had already been mostly completed in March. A neighbor, Jillian Kachuk, told the board she and adjacent neighbors support the enclosed porch and that the old steps needed repair.
The Horvaths supplied photos and a floor plan included in the record and said restoring the prior railing would be costly and impractical because the original railing had been discarded. The board asked clarifying questions about dimensions, whether the footprint changed (it did not), and whether the structure was heated (the applicants said it is a three-season room, not heated). After closing public comment the board moved to approve case 31-26; the vote carried 5-0 and the application was approved.
