Westfir council reviews code-enforcement limits and new abatement option

Westfir officials described persistent obstacles to enforcing nuisance and code violations at the Jan. 22 work session, citing cases like occupied RVs where photographic evidence and unwilling witnesses make court enforcement difficult. The city recorder said the municipal court judge confirmed Westfir’s charter permits issuance of warrants for direct abatement, but that pursuing warrants would require substantial legal work and attorney involvement.
“ Previously Westborough was not able to directly abate nuisances by administrative warrant. I recently confirmed with the Oak Ridge Municipal Court Judge that Westborough's charter does give him the authority to issue warrants,” the city recorder said, adding that the process is "quite an intensive process" and would require city-attorney support. Councilors discussed whether some issues are more appropriately handled through land-use code amendments and noted that code changes are laborious and can be expensive to pursue.
