DRB approves Masterson contractor’s yard on Kings Way with conditions

The New Haven Development Review Board voted 5–0 on July 6 to approve Conditional Use Application #2026-DRB-12-CU, allowing Masterson & Son Excavation and Murray & Masterson Environmental Services to relocate operations to Lots 3 and 4 of the Norris Subdivision on Kings Way.
The application, presented by applicant Josh Masterson and consultant Greg McKenney, proposed a two-story 80-foot by 120-foot building to house offices, shop space and equipment storage and an adjacent contractor’s yard. Landowner Peter Norris noted the project is part of a larger subdivision and has a pre-existing Act 250 permit and wastewater permit; Murray & Masterson will amend the Act 250 permit and obtain a construction stormwater permit before work begins. The applicants estimated 15–20 employees onsite and roughly 100 additional one-way vehicle trips per day, and said some materials (hay and topsoil) will remain at the Masterson Bristol location rather than moving to Kings Way.
Board members discussed site layout, traffic, hours and lighting. Member Don Johnston successfully moved an amendment requiring the final site plan map to show traffic flow; Vice Chair Kathy Barrett asked for an explicit provision allowing emergency operations at any hour and confirmed applicants agreed to install motion-activated lighting to meet the Town’s Dark Sky policy. Member Tom Fyles moved to approve the application as presented, Member Tim Paquette seconded, and the amended motion carried with five members voting in favor (Tom Fyles, Tim Paquette, Victor LaBerge, Don Johnston, Kathy Barrett) and none opposed. The board then closed the application and deferred approval of prior meeting minutes for lack of quorum from those earlier meetings.
Construction is scheduled to begin in spring 2027 with an estimated eight-month timeline, according to applicants. The approval is conditioned on the final site plan showing traffic flow and the agreed lighting and emergency-hour provisions; applicants will proceed with required permitting steps, including the construction stormwater permit and Act 250 amendment.
