Board authorizes expedited CR105 filing to align WAC Title 314 with 2025 laws

The Liquor and Cannabis Board approved filing an expedited CR105 rulemaking package intended to align WAC Title 314 with statutory changes enacted in the 2025 legislative session.
Kevin Walder, the agency’s policy and rules manager, explained that the proposed changes are ‘‘explicitly dictated in statute, and the board has no discretion regarding implementation.’’ He listed three primary bills driving the updates: House Bill 1636 (which eliminated a 24‑liter‑per‑transaction limit for certain resales), House Bill 1698 (terminology changes and updates to mandatory server training), and 2nd Substitute Senate Bill 5786 (fee updates for licenses and permits). "Because the proposed rule changes are limited to only revisions that are explicitly dictated in statute, the board has no discretion regarding implementation," Walder said.
Walder described the schedule: if the board approves filing on Nov. 19, staff will open a public comment period through Jan. 3 and, if no substantive changes are warranted, will seek approval to file CR103 to adopt permanent rules at the Jan. 7, 2026 board meeting with earliest eligible filing on Feb. 7. The package also includes minor typographical corrections and repeal of temporary COVID‑era temporary provisions that statute has since repealed.
The board moved to approve the filing of the expedited package after Walder’s presentation. The motion was made and seconded and recorded in the meeting transcript as carried.
