Council adopted ordinance 8253 after staff presented the proposal to become an authorized agent with the Texas Commission on Environmental Quality for on‑site sewage facilities. Anthony Spinel (staff) said the ordinance largely uses TCEQ template language but includes five proposed local amendments: permit all systems regardless of acreage, limit short‑term ATC (authorization to construct) tied to sanitary nuisance to 90 days, allow a potable water distribution line variance, require annual BOD/TSS grab sampling for food establishments served by on‑site systems, and require audible and visible high‑water alarms for certain new construction pump‑tank systems.
Spinel said the proposal follows outreach to Potter and Randall counties, the Texas On‑site Wastewater Association (TOWA) and the local Realtor Association; staff removed a prior proposal to require on‑site inspections at real‑estate transactions after feedback. Council asked about retroactivity and cost impacts; staff answered that new alarm requirements would apply only to new construction and estimated a modest owner cost of a few hundred dollars. The ordinance passed at first reading in the public‑hearing segment and will be implemented through the required administrative steps and state coordination.
