Ellis County signs reimbursement and review agreements with Tallgrass for proposed solar farm; commissioners stress no county subsidy

Ellis County commissioners voted to enter agreements that will let the county hire outside legal and technical reviewers for a proposed Tallgrass/IBV solar farm while the developer reimburses those costs.
“By entering into these agreements, this does not commit Ellis County to proceed with anything,” County Administrator Darren Myers said. The package approved included (1) an escrow/reimbursement agreement with the developer to cover county consulting and legal fees, (2) an engagement letter with Foulston Law Office for legal review, and (3) a contract with AcreStrong LLC for independent solar‑project technical analysis.
Tallgrass representative Steve Link answered public concerns about decommissioning and tax treatment, saying long‑term leases include restoration commitments and that the 10‑year pilot referenced in discussions is a financial arrangement rather than an ownership change. Link said the company models curtailment risk and transmission constraints as part of project planning. He told the commission, “These projects are in service for 35 to 40 years,” and that the company accounts for grid and curtailment risk in its financial modeling.
Public commenter Mike Wirth raised questions about post‑abatement ownership, transmission capacity and maps showing panels near floodplain areas; the commission said the contracted reviewers will help answer such technical and legal questions. Commissioners voted to approve the agreements and instructed staff to set up the escrow account and begin review work under the developer’s reimbursement cap.
