Special Magistrate reduces 7‑Eleven fine to $9,200 after manager says he missed notice while hospitalized

Code Enforcement Officer Joseph Petrick told the magistrate the property had been found in repeat violation of Section 58-584 for trash, debris and unmaintained landscaping and that fines totaling $18,400 had accrued. Petrick said the property is now in compliance and that he had met with the store's landscaping contractor about restoring the approved landscape plan. Petrick reported the cost to bring the case to hearing as $14.72.
The Store Manager, Mohammed Ali, testified that he had not received the Notice concerning an earlier hearing and that, after receiving the August 27 order, he spoke with CEO Petrick about steps to achieve compliance. Ali also said he had been sick and hospitalized for seven days during the period when fines accrued. The Special Magistrate's written order states, in part, "the fine against Respondent's property is hereby reduced to the amount of Nine Thousand Two Hundred ($9,200.00) Dollars." The order requires payment of the reduced fine by April 1, 2026, or the original $18,400 will be automatically reinstated.
The hearing record notes the property was in compliance at the time of the hearing; the reduced fine and the payment deadline are the magistrate's final directions on the matter unless the town reopens enforcement for nonpayment.
