City Council affirms WinCo permit with conditions after de novo appeal

The Woodburn City Council on June 8 affirmed the Planning Commission's approval of an application by WinCo Foods for an 84,000-square-foot store on the west side of Evergreen Road. The decision follows a de novo public hearing in which staff, the applicant, opponents and supporters presented evidence and argument. "Staff's recommendation is to affirm the PC's decision," Community Development Director Chris Kirk told the council.
The WinCo application included a property-line adjustment, design review, a street adjustment and three variances (EV charging spaces, increased west‑facing wall signage, and taller parking‑lot light poles with conditions for reduced pole heights near residences). Staff and the Planning Commission recommended approval with conditions that include an on-site Transportation Demand Management plan, off-site pedestrian improvements, a bus shelter, and coordination with ODOT on signalization and short-term intersection improvements. The applicant also agreed to a shopping-cart locking perimeter system to reduce carts leaving the site.
Protect Our Valley Alliance (POVA), the appellant, argued the applicant's traffic analysis understated pass-by trips and that the proposal would exceed some Interchange Management Area (IMA) trip allocations without showing it "contributes substantially to the economic objectives" of the comprehensive plan. The appellant requested the record be held open to allow its traffic engineer additional time to review supplemental materials submitted by the applicant two working days earlier; the council closed the public hearing and proceeded to deliberation.
After discussion, a motion to affirm the Planning Commission's decision and direct staff to prepare a final land-use decision passed on a roll-call vote. The council asked staff to incorporate any additional findings raised during the hearing into the final decision and to return the prepared decision for council consideration at the next available meeting. The council's action is procedural and subject to appeal to the Oregon Land Use Board of Appeals by parties with standing.
