Planning staff proposes shorter appeal period and higher fines to align ordinance with Code of Virginia

At the start of the public-hearing portion, staff introduced a zoning ordinance text amendment to section 13-300 (appeals) and section 13-600 (violations) to bring Fauquier County code into alignment with recent changes to the Code of Virginia. The planner said the Code now permits zoning ordinances to prescribe appeal periods shorter than 30 days but not less than 10 days for some notices of violation and allows increased fines to the state maximum.
The planner told commissioners the draft amendment “adds language reducing the appeal period for violations related to this issue from 30 days to 10 days and the minimum permitted by the code.” Staff said the commission could recommend a longer appeal period at its discretion. No public speakers were recorded on this item during the summary presentation.
